Job Description

We are seeking a highly skilled and knowledgeable Employment-Based Immigration Attorney to join our team in our San Diego office. The ideal candidate will have substantial experience managing the full range of employment-based immigration processes, including work visas, green cards, PERM labor certifications, H-1B, L-1, O-1 visas, and other related matters. The Employment-Based Immigration Attorney will be responsible for advising and representing clients—both individuals and corporations—on immigration compliance, visa applications, and navigating complex immigration requirements.

This position requires the ability to manage a caseload of employment-based immigration matters, maintain excellent client relationships, and stay up to date on current immigration laws, regulations, and trends impacting employers and their workforce.

Key Responsibilities:

  • Provide expert legal counsel and strategic advice on employment-based immigration matters, including H-1B, L-1, O-1, TN, PERM labor certification, EB-1, EB-2, EB-3, and adjustment of status applications.
  • Advise clients on immigration compliance, work authorization, and visa options for foreign workers.
  • Prepare and file petitions for various employment-based visas, including drafting applications and supporting documentation.
  • Represent clients in front of U.S. Citizenship and Immigration Services (USCIS), the U.S. Department of Labor (DOL), and other governmental agencies regarding employment-based immigration matters.
  • Work closely with human resources teams, legal teams, and other stakeholders to ensure compliance with immigration laws and regulations.
  • Develop strategies for handling complex cases, including RFE (Request for Evidence) responses and appeals.
  • Monitor the status of cases and track immigration deadlines to ensure timely submissions and compliance.
  • Provide training and guidance to corporate clients on immigration compliance and best practices for managing foreign workers.
  • Stay up to date with changing immigration laws, policies, and regulations affecting employment-based immigration.

Qualifications:

  • Juris Doctor (JD) from an accredited law school.
  • Active state bar membership
  • Minimum of 2 years of experience in employment-based immigration law, including hands-on experience with visa applications and PERM labor certifications.
  • Strong knowledge of U.S. employment-based immigration laws, including both nonimmigrant and immigrant visa categories.
  • Proven experience in managing complex immigration cases and responding to RFEs and NOIDs (Notices of Intent to Deny).
  • Excellent written and verbal communication skills, with the ability to explain complex legal matters clearly to clients and colleagues.
  • Ability to manage a high-volume caseload and meet strict deadlines.
  • Strong attention to detail and organizational skills.
  • Experience working with corporate clients and large organizations is preferred.
